    General Summary:

    This position is responsible for managing and resolving Landlord special requests (condemnations, easements, etc.), Tenant default notices, and LL account receivables resulting from Lease Compliance self-help activity. This individual also supports company merchandising initiatives by securing Landlord consent for requests such as sidewalk displays (Redbox, propane) and permits/licenses for the sale of alcohol. This individual must utilize critical thinking, problem-solving and analytical skills to negotiate lease modification agreements, perform in-depth lease research, and apply practical real estate knowledge in making appropriate decisions and enforcing lease provisions with minimal supervision.

     

    Duties & Responsibilities:

    • Manage Landlord special requests (rights-of-way, condemnations, easements, lease restrictions, parcel splits, common area alterations, etc). Assess lease/legal implications of request and partner with field Ops to understand impact on our business operations. Conduct independent negotiations with the Landlord, Property Manager or Landlord’s attorney and perform a financial metrics analysis for each project. Secure appropriate exhibits to memorialize negotiated changes, and present recommendation to Director of Lease Compliance & Renewals and Sr. Director of Lease Administration.
    • Manage Landlord account receivables (AR) program to ensure maximum monetary recoveries are made for issues where Dollar General invoked self-help rights. This responsibility includes: review the lease to confirm Dollar General’s right to invoke self-help and request reimbursement, ensure all lease mandated notices and supporting documents were forwarded to the Landlord timely and to the correct legal notice address, verify issues progressed through the system in accordance established procedures, secure invoices from third party vendors and review for accuracy, and progress AR workflow in Lucernex to Rent Administration for collection. Provide bi-weekly reports to Director of Lease Compliance & Renewals and Sr. Director of Store Facilities Management with departmental spend and AR collection activity.
    • Resolve instances of Tenant (DG) default by researching and interpreting lease obligations, determine the appropriate corrective measures and partner with internal partners (Real Estate Legal, Risk Mgmt., field Ops, etc.) to initiate plan of action to ensure compliance of the lease. Communicate with Landlords and/or their attorneys regarding the plan of action and/or disputes claim.
    • Support company merchandising initiatives (ex. Redbox, Propane, Sidewalk sales, beer and wine, etc.) by providing direction regarding lease requirements and restrictions. Negotiates terms of Landlord consent agreements when required. Drafts and negotiates legal documents (Lease Modification Agreements, Letters of Consent, Waivers, etc.) and facilitates execution.
    • Develops and manages reports to communicate on-going activities to senior management, seeking direction on site-specific issues as necessary. Drafts highly structured lease language and creates legal documents (as necessary) in accordance with the Lease and Law Department established guidelines, securing assistance from in-house counsel as needed.

    • Advanced knowledge and understanding of real estate concepts, practices and procedures
    • Advanced understanding of legal documents and legalese

    • Knowledge and understanding of the retail industry
    • Ability to understand market data information
    • Knowledge and understanding of financial concepts (IRR, EBITDA, gross margin, etc.)
    • Self-motivated to achieve company, departmental and personal goals
    • Ability to manage and track, in an organized manner, a large volume of tasks
    • Intermediate knowledge of word processing, spreadsheet, and database applications
    • Capable of working independently
    • Ability to effectively communicate both verbally and in written form to a large variety of internal and external partners

     

    Work Experience &/or Education:

    Paralegal, Business Management degree (or related field) or demonstrable equivalent experience.

    At least five (5) years’ experience in Facilities Management, Legal, or Lease Administration fields preferably in a retail environment.
